Acceptance of Terms

By accessing, browsing, or using the Mobile Dukan website at mobiledukan.pk ("Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms"), our Privacy Policy, and any other policies referenced herein. If you do not agree to these Terms, you must immediately cease using Mobile Dukan.

Mobile Dukan reserves the right to update, modify, or replace these Terms at any time. Continued use of the Platform following any changes constitutes your acceptance of the revised Terms.

Platform Description

Mobile Dukan is an online mobile phone marketplace that connects buyers and sellers of new and used mobile phones, smartphones, tablets, and related accessories in Pakistan. Mobile Dukan acts as a platform facilitator — we do not directly buy, sell, or hold inventory of mobile devices unless expressly stated.

Eligibility

To use Mobile Dukan, you must:

  • Be at least 18 years of age.
  • Be a resident of or legally present in Pakistan.
  • Have the legal capacity to enter into binding contracts under Pakistani law.
  • Not be previously banned or suspended from using Mobile Dukan.

User Accounts

Certain features of Mobile Dukan require account registration. When creating an account, you agree to:

  • Provide accurate, complete, and current information during registration.
  • Maintain the security of your account credentials and not share them with others.
  • Notify Mobile Dukan immediately of any unauthorised access to your account.
  • Be responsible for all activities that occur under your account.

Seller Responsibilities

As a seller on Mobile Dukan, you agree to the following obligations:

  • Accurate Listings: All mobile phone listings must be accurate, complete, and not misleading.
  • Legal Ownership: You must be the legal owner of any mobile phone listed on Mobile Dukan.
  • PTA Compliance: Mobile phones listed must comply with PTA regulations regarding device registration and IMEI compliance.
  • Fulfillment: You are obligated to complete all sales you agree to in a timely and professional manner.
  • Honest Condition Reporting: Accurately describe the condition of used mobile phones — including any defects.
  • Prohibited Items: Listing stolen phones, devices with blocked IMEI numbers, or counterfeit devices is strictly forbidden.

Buyer Responsibilities

As a buyer on Mobile Dukan, you agree to:

  • Conduct due diligence before making a purchase.
  • Complete purchases honestly and not engage in fraudulent disputes.
  • Inspect mobile phones upon delivery and report any discrepancies within the return window.
  • Comply with all applicable Pakistani laws regarding mobile device use.

Transactions & Payments

  • All prices listed on Mobile Dukan are in Pakistani Rupees (PKR).
  • Mobile Dukan supports JazzCash, EasyPaisa, bank transfer, debit/credit cards, and Cash on Delivery.
  • Mobile Dukan may charge marketplace fees, clearly disclosed before listing.
  • Mobile Dukan is not responsible for disputes arising outside our platform's process.

Prohibited Conduct

  • Listing or selling stolen mobile phones or devices with tampered IMEI numbers.
  • Posting false, misleading, or fraudulent listings.
  • Engaging in price manipulation, shill bidding, or fake reviews.
  • Harassing, threatening, or abusing other users.
  • Circumventing Mobile Dukan to conduct off-platform transactions.
  • Attempting to gain unauthorised access to our systems or other users' accounts.

Returns & Dispute Resolution

  • Buyers may initiate a return within 3 days of receiving a phone that differs from its description.
  • Disputes must be filed through Mobile Dukan's official process.
  • Our dispute resolution team reviews evidence from both parties and delivers a fair decision.
  • Mobile Dukan's decisions on disputes are final and binding.

Limitation of Liability

To the fullest extent permitted by Pakistani law, Mobile Dukan shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including the conduct of other users, loss of data, or Platform downtime.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes shall be subject to the exclusive jurisdiction of the courts of Pakistan.
